Terms of Use

These Terms of Use ("Terms") govern your use of the Quizel iOS app ("Quizel", "the app", "we", "us", or "our"). Quizel is provided by Vincent Tietze. You can contact us about legal questions at quizel.support@protonmail.com.

1. Acceptance

By downloading, accessing, or using Quizel, you agree to these Terms and to any applicable Apple App Store terms. If you do not agree, do not use the app.

These Terms supplement Apple's Standard End User License Agreement unless a separate custom EULA is published in App Store Connect. If Apple's required terms conflict with these Terms, Apple's required terms apply to the extent of the conflict.

2. What Quizel Does

Quizel helps you create multiple-choice practice quizzes from study material you provide, such as pasted notes, PDFs, text files, and selected images. The app may use AI services to generate and validate quiz questions.

Quizel is a study aid. It does not guarantee that generated questions, answers, explanations, or summaries are complete, accurate, or suitable for any exam, school, university, certification, job, or other purpose.

3. Your Study Material

You are responsible for the material you submit to the app. You represent that you have the right to use and submit that material for quiz generation.

You retain ownership of your study material. You grant us the limited right to process submitted material only as needed to provide quiz generation, validation, abuse prevention, subscription verification, support, and service operation.

4. AI Output

Quizel uses AI to generate and check quizzes. AI output can be wrong, incomplete, outdated, or misleading. You should review generated quizzes before relying on them.

You are responsible for how you use generated quiz content. Quizel is not responsible for exam outcomes, academic decisions, professional decisions, or other consequences of relying on generated content.

5. Subscriptions

Quizel may offer auto-renewable subscriptions called Quizel Pro, currently available as a weekly plan and a 6-month plan. Prices are shown in the app before purchase.

Quizel Pro provides expanded or unlimited quiz generation while the subscription is active, subject to fair-use, abuse-prevention, backend availability, and technical limits.

New subscribers may receive an introductory free trial (currently one week). If the subscription is not canceled at least 24 hours before the trial ends, the paid subscription starts automatically at the selected plan's price.

Subscriptions are purchased through Apple's in-app purchase system. Payment is charged to your Apple ID. Subscriptions renew automatically at the selected plan's price and duration unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your Apple ID account settings.

We do not process payment card details. Refund requests are handled by Apple according to Apple's policies.

Quizel Pro is digital content that becomes available immediately after purchase. If you are a consumer in the EU/EEA, your statutory right of withdrawal (Widerrufsrecht) may expire once the subscription begins with your prior express consent, in accordance with the App Store purchase terms. Apple acts as the seller of record and handles the purchase contract, withdrawal, and refund requests.

6. Free Use and Limits

Free use may be limited, including a daily quiz generation quota and backend attempt limits. Limits may change to prevent abuse, control cost, or maintain service quality.

8. Availability and Changes

Quizel may be unavailable from time to time due to maintenance, provider outages, network issues, App Store changes, or backend limits. We may change, suspend, or discontinue features at any time.

10. No Warranty

Quizel is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of accuracy, reliability, availability, fitness for a particular purpose, and non-infringement.

Mandatory statutory warranty and consumer-protection rights that cannot be excluded under applicable law, including under German law, remain unaffected.

11. Limitation of Liability

Vincent Tietze is liable without limitation for damages arising from intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for damages resulting from injury to life, body, or health, for liability under the German Product Liability Act (Produkthaftungsgesetz), and to the extent a guarantee has been given.

In the case of simple negligence, Vincent Tietze is liable only for the breach of an essential contractual obligation — an obligation whose fulfilment is necessary for the proper performance of the contract and on whose observance you may reasonably rely (a "cardinal obligation"). In that case, liability is limited to the foreseeable damage typical for this type of contract.

Any further liability for simple negligence is excluded. In particular, subject to the paragraphs above, we are not liable for indirect or consequential damages, lost profits, lost data, or academic, exam, or professional outcomes arising from your use of Quizel.

These limitations also apply in favour of the legal representatives, employees, and agents of Vincent Tietze. Your mandatory statutory rights as a consumer remain unaffected.

12. Termination

You may stop using Quizel at any time by deleting the app. We may suspend or terminate access to the backend service if we reasonably believe these Terms are being violated. Sections that by their nature should survive (including AI output responsibility, warranty disclaimer, and limitation of liability) survive termination.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer protection provisions of the country in which you habitually reside.
