Terms of Use

These Terms of Use ("Terms") govern your use of the Quizel iOS app ("Quizel", "the app", "we", "us", or "our"). Quizel is provided by Vincent Tietze. Full provider and postal contact details are available in the Impressum. You can contact us about legal questions at quizel.support@protonmail.com.

1. Acceptance

By downloading, accessing, or using Quizel, you agree to these Terms and to any applicable Apple App Store terms. If you do not agree, do not use the app.

These Terms supplement Apple's Standard End User License Agreement unless a separate custom EULA is published in App Store Connect. If Apple's required terms conflict with these Terms, Apple's required terms apply to the extent of the conflict.

2. What Quizel Does

Quizel helps you create multiple-choice practice quizzes from study material you provide, such as pasted notes, PDFs, text files, and selected images. The app uses AI services to generate quiz questions, and the Quizel backend validates the returned quiz structure before it reaches the app.

Quizel is a study aid. It does not guarantee that generated questions, answers, explanations, or summaries are complete, accurate, or suitable for any exam, school, university, certification, job, or other purpose.

3. Your Study Material

You are responsible for the material you submit to the app. You represent that you have the right to use and submit that material for quiz generation.

Do not submit material that:

• you do not have permission to use;
• contains passwords, payment details, government identifiers, or private health information;
• is illegal, harmful, abusive, or infringes another person's rights;
• you are contractually or legally prohibited from sharing with third-party AI services.

You retain ownership of your study material. You grant us the limited right to process submitted material only as needed to provide quiz generation, validation of the returned quiz structure, abuse prevention, subscription verification, support, and service operation.

4. AI Output

Quizel uses AI to generate quizzes and automatically checks the returned quiz structure. This technical check does not verify factual accuracy. AI output can be wrong, incomplete, outdated, or misleading. You should review generated quizzes before relying on them.

You are responsible for how you use generated quiz content. Quizel is not responsible for exam outcomes, academic decisions, professional decisions, or other consequences of relying on generated content.

5. Subscriptions

Quizel offers auto-renewable annual and weekly Pro subscriptions; legacy six-month subscriptions may remain active. Prices and billing periods are shown before purchase. Eligible annual subscribers may receive a 7-day free introductory trial, with eligibility determined by Apple. The weekly plan has no free trial. The trial includes Pro quiz and flashcard generation, but no included Voice Mode minutes. Apple charges the displayed price at purchase or after an eligible trial, unless cancelled. Renewal is automatic unless cancelled at least 24 hours before the trial or billing period ends. Manage subscriptions in your Apple Account settings. Annual billing is for a full year; a weekly equivalent is only a comparison. Apple handles payment and refund requests. Mandatory consumer, warranty, withdrawal and refund rights remain unaffected.

6. Free Use and Limits

In current app versions, creating quizzes and flashcards from your own material requires an active Quizel Pro subscription, including an eligible introductory trial. The onboarding example can be tried without generating personal content. Existing saved quizzes, flashcards and progress remain accessible after a subscription ends. The former free five-item personal starter is no longer offered. Technical and abuse-prevention limits may apply.

7. Acceptable Use

You agree not to:

• abuse, overload, reverse engineer, scrape, or attack the app or backend;
• bypass quotas, subscription checks, or abuse-prevention systems;
• use the app to generate unlawful, harmful, or infringing content;
• use the app in a way that violates applicable law or third-party rights.

We may restrict access if we reasonably believe the app or backend is being misused.

8. Availability and Changes

Quizel may be unavailable from time to time due to maintenance, provider outages, network issues, App Store changes, or backend limits. We may change, suspend, or discontinue features at any time.

10. No Warranty

Quizel is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of accuracy, reliability, availability, fitness for a particular purpose, and non-infringement.

Mandatory statutory warranty and consumer-protection rights that cannot be excluded under applicable law, including under German law, remain unaffected.

11. Limitation of Liability

Vincent Tietze is liable without limitation for damages arising from intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for damages resulting from injury to life, body, or health, for liability under the German Product Liability Act (Produkthaftungsgesetz), and to the extent a guarantee has been given.

In the case of simple negligence, Vincent Tietze is liable only for the breach of an essential contractual obligation — an obligation whose fulfilment is necessary for the proper performance of the contract and on whose observance you may reasonably rely (a "cardinal obligation"). In that case, liability is limited to the foreseeable damage typical for this type of contract.

Any further liability for simple negligence is excluded. In particular, subject to the paragraphs above, we are not liable for indirect or consequential damages, lost profits, lost data, or academic, exam, or professional outcomes arising from your use of Quizel.

These limitations also apply in favour of the legal representatives, employees, and agents of Vincent Tietze. Your mandatory statutory rights as a consumer remain unaffected.

12. Termination

You may stop using Quizel at any time by deleting the app. We may suspend or terminate access to the backend service if we reasonably believe these Terms are being violated. Sections that by their nature should survive (including AI output responsibility, warranty disclaimer, and limitation of liability) survive termination.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer protection provisions of the country in which you habitually reside.
